website-terms-2026-08-16-v3-candidate
These terms govern ordinary use of The Spokesdude Network website. They do not by themselves create a paid consulting engagement or replace a customer-specific written scope.
This document is not active for paid electronic contracting until approved and published.
Website operator and contact details
This website is operated by The Spokesdude Network (Pty) Ltd, a company registered in South Africa. Website enquiries may be directed to info@thespokesdude.com or +27 81 459 4840. These Website Terms govern website use and qualification enquiries only; they do not create an electronic checkout or paid service contract. Applicable supplier, price, payment, delivery and cancellation information will be provided before any electronic service transaction is concluded.
1. Identity, Scope and Acceptance
The Spokesdude Network (Pty) Ltd operates this website. These Website Terms govern ordinary access to and use of this website, including public pages, enquiries, campaign pages, contact forms and linked online content.
Using the website does not by itself create a paid service engagement. A paid agreement is formed only when The Spokesdude Network issues a customer-specific written scope identifying every incorporated term and the customer expressly accepts that exact scope and those terms.
If any mandatory law gives you rights that cannot be excluded, these Website Terms must be read subject to those rights.
2. Website Information
The website describes The Spokesdude Network's services, campaigns, case studies, insights and contact options. This information is general, may change, and is not legal, accounting, tax, investment or other regulated professional advice.
Where a page contains a specific campaign price, timing statement or qualification rule, that campaign page and the applicable offer terms must be read together.
We take reasonable care with website content, but we do not guarantee that every page is always complete, uninterrupted or free from error.
3. Enquiries and Quotations
A submitted form, WhatsApp message, email or telephone discussion is normally an enquiry. It is not automatic acceptance of work and does not guarantee price, availability or delivery timing.
Marketing prices and specials remain subject to their stated qualification rules. The Spokesdude Network may decline an enquiry, request more information, or issue a separate quotation.
4. Acceptable Website Use
You may use the website for lawful information, accessibility, search, personal reference and ordinary business-enquiry purposes.
You must not misuse the website by attempting unlawful access, interfering with availability, overloading forms or services, uploading malicious material, impersonating another person, scraping in a way that burdens the service, bypassing security controls, or knowingly submitting content you are not authorised to provide.
5. Intellectual Property
Website text, design, branding, graphics, layouts, code and other original materials belong to The Spokesdude Network or its licensors unless stated otherwise.
You may view and refer to the website for ordinary personal or internal business purposes. Any reproduction, republication, commercial reuse or brand use requires written permission unless the law permits it.
Third-party names, tools, marks and content remain the property of their respective owners.
6. External Services and Links
The website may link to or use third-party services, including hosting, email, WhatsApp, analytics, authentication and other operational providers.
We take reasonable care in selecting operational services, but third-party systems may have their own terms, availability, security and privacy controls. We are not responsible for third-party content that we do not control.
Using a third-party provider does not remove any responsibility that applicable law places on The Spokesdude Network for providers processing information or performing services on its behalf.
7. Availability and Security
The website may be maintained, updated, changed, interrupted or unavailable from time to time. We do not guarantee uninterrupted availability.
You should use reasonable device, browser and security precautions when accessing any website or online communication channel.
8. Privacy and Analytics
Our linked Privacy Policy explains the personal information and limited analytics data processed through the website and enquiry flows, the purposes, providers and applicable rights.
At this version date, The Spokesdude Network does not intentionally use advertising trackers or third-party behavioural profiling. If those practices change, the Privacy Policy and relevant notices will be updated before or when the change takes effect as required by law.
9. Important Website-Information Notice
Website content is general information and is not prepared as advice for a particular person or decision. To the extent permitted by law, The Spokesdude Network is not responsible for loss caused solely by reliance on that general information without an agreed professional service, or by an interruption outside its reasonable control.
The Spokesdude Network remains responsible for exercising reasonable care in operating the website and for duties that applicable law does not permit it to exclude or limit.
Nothing in these Website Terms excludes or limits liability for gross negligence, intentional wrongdoing, fraud, a breach of non-excludable privacy or consumer duties, or any other liability that South African law does not permit to be excluded or limited.
Non-excludable rights preserved
This website limitation is limited to website use. It does not remove non-excludable consumer, privacy or service-quality rights.
10. Complaints and Notices
Website-related complaints or notices may be sent to info@thespokesdude.com. Please include your name, contact details, the page or issue involved and enough information for us to respond.
We will consider the issue and respond through a reasonable channel. Urgent security concerns should not include passwords, sensitive workbooks or unnecessary personal information.
Nothing in this complaints process prevents a person from approaching the National Consumer Commission, Information Regulator, another competent body or a court where applicable.
11. Governing Law
These Website Terms are governed by the laws of the Republic of South Africa, subject to any consumer, privacy or other mandatory rights that may apply.
Nothing in these terms prevents a person from approaching a competent regulator, statutory body or court where the law allows it.
12. Changes and General Terms
We may update these Website Terms prospectively. The version published on this page applies to website use from its effective date unless another accepted agreement lawfully provides otherwise.
Changes do not retrospectively alter a paid engagement or another agreement already accepted. Material changes receive a new version and effective date. Rights and obligations that arose before a change remain unaffected unless lawfully varied by agreement.
If a clause is found unenforceable, the remaining clauses continue as far as the law allows. A delay in enforcing a right does not mean that right has been waived.
